Terms and Conditions

1. Disclaimer of Warranty. THIS SITE IS PROVIDED "AS IS" WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESSED OR IMPLIED, INCLUDING BUT NOT LIMITED TO THE IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSES, OR NON-INFRINGEMENT. The VIP Card, Inc also assumes no responsibility, and shall not be liable for any such damages to or viruses that may infect, your computer equipment, software, data or other property on account of your access to, use of, or browsing in the Site or your downloading of any materials, data, text, images, video or audio from the Site or any linked sites.
2. You may not distribute, modify, transmit, reuse, re-post, or use the content of the Site for public or commercial purposes, including the text, images, audio and video without written permission from The VIP Card, Inc. Changes periodically are made to the information contained in this Site.
3. Limitation of Liability. In no event shall The VIP Card, Inc or any other party, involved in creating, producing, maintaining or delivering the Site, or any of their affiliates, or the officers, directors, employees, shareholders, or agents of each of them, be liable for any damages of any kind, including without limitation any direct, special, incidental, indirect, exemplary, punitive or consequential damages, whether or not advised of the possibility of such damages, and on any theory of liability whatsoever, arising out of or in connection with the use or performance of, or your browsing in, or your links to other sites from, this Site.
4. You are prohibited from posting or transmitting any unlawful, threatening, libelous, defamatory, obscene, scandalous, inflammatory, pornographic, or profane material or any material that could constitute or encourage conduct that would be considered a criminal offense, give rise to civil liability, or otherwise violate any law. The VIP Card, Inc will fully cooperate with any law enforcement authorities or court order requesting or directing The VIP Card, Inc to disclose the identity of or help identify or locate anyone posting any such information or materials.
5. Any communication or material you transmit to the Site by e-mail or otherwise, including any data, questions, comments, suggestions, or the like is, and will be treated as, nonconfidential and non-proprietary. The VIP Card, Inc cannot prevent the "harvesting" of information from this Site, and you may be contacted by The VIP Card, Inc or unrelated third parties, by e-mail or otherwise, within or outside of this Site. Anything you transmit may be edited by or on behalf of The VIP Card, Inc, may or may not be posted to this Site at the sole discretion of The VIP Card, Inc and may be used by The VIP Card, Inc or its affiliates for any purpose, including, but not limited to, reproduction, disclosure, transmission, publication, broadcast and posting. Furthermore, The VIP Card, Inc is free to use any ideas, concepts, know-how, or techniques contained in any communication you send to the Site for any purpose whatsoever including, but not limited to, developing, manufacturing and marketing products using such information.
6. New users signing up to use the vip eblast site must be 18 years or older.
7. No purchase necessary to enter the prize draw.
8. This prize draw is open to US residents aged 18 years or over, with the exception of employees of the VIP Card, Inc, their families, agents and anyone else connected with this promotion.
9. Entries must be received by midnight on 31st December 2010. The Promoter accepts no responsibility for any entries that are incomplete, illegible, corrupted or fail to reach the Promoter by the relevant closing date for any reason. Proof of posting or sending is not proof of receipt. Entries via agents or third parties are invalid. Entries become the property of the Promoter and are not returned.
10. Entries are made for the Grand Prize with each online VIP Card purchase that credits the Applicant (See #5 for application instructions.)
11. To become an applicant sign up for a VIP E-Blast account and fill in your details on the online form found at www.vipeblast.com. You must be part of an active fundraiser participating with The VIP Card, Inc in order to participate.
12. All correctly completed entries from each fundraiser nationwide will be entered into a single nationwide prize draw which will take place on 1st February 2011. The first entry drawn will be the winner.
13. The Grand Prize is a $1,000 worth of Target Gift Cards.
14. Prizes are subject to availability. In the event of unforeseen circumstances, the Promoter reserves the right (a) to substitute alternative prizes of equivalent or greater value and (b) in exceptional circumstances to amend or foreclose the promotion without notice. No correspondence will be entered into.
15. The winner will be notified via email or post by February 26th 2011. The winner must claim their prize within 14 working days of the Promoter sending notification. If the prize is unclaimed after this time, it will lapse and the Promoter reserves the right to offer the unclaimed prize to a substitute winner selected in accordance with these rules.
16. To obtain details of the winner please email info@thevipcard.com stating the name of the prize draw in the subject heading four weeks after the closing date.
17. The Promoter will use any data submitted by entrants only for the purposes of running the prize draw, unless otherwise stated in the entry details. By entering this prize draw, all entrants consent to the use of their personal data by the Promoter for the purposes of the administration of this prize draw and any other purposes to which the entrant has consented.
18. The winner agrees to take part in reasonable post event publicity and to the use of their name and photograph in such publicity.
19. By entering the prize draw each entrant agrees to be bound by these terms and conditions.
